BANDUNG (IndoTelko) - The Indonesian government is expected to soon issue a legal framework that would regulate and provide legal protection for all Information Communication Technology (ICT) users in the country.

"We need legal protection of personal data which would provide economic benefits to Indonesia. If not, then the potential loss is estimated to reach Rp 500 billion per year said a lecturer from the Faculty of Law, University of Padjadjaran Sinta Dewi Rosadi, lately.

Based on her calculations, the estimation is obtained from the potential of global trade services sector that has accounted for 50% of the world trade. Including data exchange related to personal data between countries.

He said, Indonesia is one country that has not specifically regulated legal protection regarding ICT usage. Meanwhile the neighboring countries have had a special arrangement for the matter.

The arrangement will protect the individual against any misuse of personal data especially when the data has high value for business purposes.
User’s personal data collection and processing becomes increasingly easier with the development of ICT.

Citing a report, there are estimated 75 million active internet users and 72 million are active users of social media. Mostly people use their mobile phone devices for interaction in the social media.

As a form of innovation, ICT is now able to perform the data collection, storage, sharing and analyzing, which can be utilize in many sectors of life such as eCommerce implementation in the trade business, e-education in the field of education, e-health in health, e-government in the field of governance.

This was further strengthened with the development of cloud computing industry and the use of the internet of things.

At the same time, through the ICT development it is possible to do obtain, storage, distribution and sale and purchase of personal data widely without the approval of the data owner, whether online or offline.

"It makes a potential breach of personal data will increase, given the personal data can be massively accessible," said Sinta.

Practices
The development of regulation for the protection of personal data in general will put Indonesia aligned with countries with advanced economy levels and has applied the law on the personal data protection.

"It will reinforce and strengthen Indonesia's position as a reliable business and investment center, which is a key strategy in the economic development of Indonesia," Sinta said.

Currently in Indonesia has a lot of direct marketing practice going on, especially in the financial industry, particularly in the management of credit cards. In practice, the privacy data of consumers have bought and sold through agents without asking prior permission from the owner of the information.

"In the last 5 years there have been many personal data breaches, which increase many public complaints. Including the emergence of a number of cases have shown that the leakage of personal data ranging from names, cellular phone numbers, e-mail addresses until all the personal data of citizens are possessed by irresponsible parties," Sinta said.

Sinta suggested that a form of personal data privacy protection that is appropriate for Indonesia is through the Co-Regulatory approach, which gives a similar role to the government and businesses to make arrangements and protection.
